Terms of Service

These terms govern your use of EbayLister, operated by Glitch Fix Designs ("we", "us"). By creating an account or using the service you agree to them. If you do not agree, do not use the service.
1. Beta software
EbayLister is in beta. Features may change, break or be removed, data loss is possible, and the service may be unavailable without notice. It is provided free during this period and we may introduce charges in future with advance notice.
2. Eligibility and your account
- You must be at least 18 and able to enter a binding contract.
- You must have, or create, your own eBay seller account. EbayLister does not sell anything on your behalf and does not act as a marketplace.
- You are responsible for keeping your login credentials secure and for activity under your account.
- Provide accurate registration information and keep it current.
3. Your eBay account
Connecting your eBay account grants EbayLister permission, through eBay's own OAuth system, to create and manage listings, read your business policies and read your seller profile. You can withdraw that permission at any time from Settings or from your eBay account.
Your relationship with eBay is separate from your relationship with us. eBay's user agreement, seller policies, listing policies, prohibited item rules and fees continue to apply to you in full. Nothing produced by EbayLister overrides them, and using this tool does not excuse a listing that breaches them.
4. AI output is a draft, not an answer
Titles, descriptions, categories, conditions, item specifics and extracted identifiers are generated automatically and can be wrong. The AI can misidentify an item, misread a label, assign the wrong category, or overstate condition. Where it is unsure it will tell you, but it will not block you from publishing.
Before you publish, you are responsible for confirming that the listing accurately describes the item, that it is legal to sell, that it complies with eBay's policies, and that it does not infringe anyone's intellectual property. Reviewing the listing is not optional diligence, it is the point of the review step.
5. Price estimates are not appraisals
Suggested prices are generated by an AI model from your photos and the condition you have set. They are not a valuation, not an appraisal, and not an analysis of comparable sold listings. Do not rely on them as financial advice. Check recent sold prices yourself before setting a price — the app links directly to eBay's sold listings search for exactly this reason.
6. Acceptable use
You agree not to:
- Upload photos or content you do not have the rights to use.
- Create listings for counterfeit, stolen, illegal or eBay-prohibited items.
- Upload unlawful content, or content depicting people without their consent.
- Attempt to connect an eBay account you do not own or control.
- Interfere with, overload, reverse engineer or circumvent limits on the service, or access it by automated means beyond normal use.
- Resell or redistribute the service without our written permission.
You retain ownership of the photos and content you upload. You grant us the licence needed to store and process them in order to run the service, including sending them to our AI provider and to eBay when you publish, as described in our Privacy Policy.
7. Suspension
We may suspend or terminate an account that breaches these terms, abuses the service, or generates costs disproportionate to normal use. A suspended account loses access to the app. Where circumstances allow, we will tell you why.
8. Availability
There is no uptime guarantee. The service depends on Google Cloud, Google's AI APIs and eBay's APIs, and can be disrupted by any of them. Listings may fail to publish; when they do, the app reports the failure so you can retry.
9. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that AI output will be accurate or complete.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales, lost data, eBay account restrictions, eBay fees, buyer disputes or returns arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim — which, while EbayLister is free, is nothing — or fifty US dollars.
Some jurisdictions do not allow these exclusions, in which case they apply to the extent permitted.
11. Indemnity
You agree to indemnify us against claims, losses and costs arising from listings you publish, items you sell, content you upload, or your breach of these terms or of eBay's policies.
12. Not affiliated with eBay
EbayLister is an independent third-party tool. It is not affiliated with, endorsed by or sponsored by eBay Inc. "eBay" is a trademark of eBay Inc., used here only to describe what the tool interoperates with.
13. Changes to these terms
We may update these terms and will revise the date above. Material changes will be announced in the app. Continuing to use the service after a change means you accept it.
14. Governing law
These terms are governed by the laws of the United States and of the state in which we operate, without regard to conflict of law rules.
